Terms of Service

Welcome to Nevatal. These Terms of Service ("Terms") govern your access to and use of Nevatal's medical practice management software and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. We may update these Terms from time to time, and your continued use of the Services after such changes constitutes acceptance of the updated Terms.

By creating an account, accessing, or using Nevatal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Nevatal on behalf of a clinic or organization, you represent that you have the authority to bind that organization to these Terms.

Nevatal operates on a subscription basis with pricing per user per month. Payment is due monthly in advance. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. If you fail to pay, we may suspend or terminate your access to the Services. For Colombian clinics, all prices are in Colombian Pesos (COP). For international customers, prices may be displayed in USD or local currency as applicable.

All content, features, and functionality of Nevatal, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are the exclusive property of Nevatal and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of all patient data and clinical information you enter into Nevatal. You grant Nevatal a limited license to use, store, and process this data solely to provide the Services to you.

To the maximum extent permitted by law, Nevatal provides the Services "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure. Nevatal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Services. Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

You may cancel your account at any time by contacting us. We reserve the right to suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in any activity that we determine is harmful to our Services or other users. Upon termination, your right to access and use the Services will immediately cease. We will retain your data for a reasonable period as required by law (for medical records, this may be up to 20 years in some jurisdictions) before deletion.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice in the Services. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and cancel your account.

These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Colombia.
